SARASOTA, Fla. (WWSB) - A Georgia couple has initiated legal action against CooperSurgical, Inc., alleging that the company's Global Culture Media was faulty, leading to the loss of sixteen embryos during their fertility treatment at the CNY Fertility clinic in Sarasota.
The lawsuit states that in late 2023, Ms. Lanier and Mr. Yarboro received IVF treatments at a fertility clinic in Florida. During the process, their embryos were cultured using Global Media, a product from CooperSurgical that aims to enhance the growth and development of embryos during IVF procedures.
Unfortunately for Ms. Lanier and Mr. Yarboro, the Global Culture Media utilized for their embryos malfunctioned, resulting in the loss of 16 of their embryos.
CooperSurgical subsequently prompted the FDA to issue a recall for multiple batches of faulty media nationwide.
“CooperSurgical was entrusted by our clients with one of the most personal and delicate parts of their lives—their desire to start a family,” stated Patrick Johnson, an attorney at Girard Sharp, who is representing the plaintiffs. “The company’s negligence in guaranteeing the safety and effectiveness of its product has resulted in irreversible damage. Brittany and Joshua have suffered the loss of valuable time, resources, and their opportunity to expand their family due to this avoidable flaw.”
The complaint details accusations against CooperSurgical for its purported negligence in the manufacturing, testing, and oversight of its culture media products, along with a reported delay in initiating a recall despite having evidence of defects in the products.
The plaintiffs are pursuing both compensatory and punitive damages, along with equitable relief, in order to hold CooperSurgical responsible for its actions.
